Georgia 10 Day Rule and How to Save Your License

An arrest for DUI can trigger an administrative suspension of your Georgia Drivers License, without you ever going to court.  If you are arrested for:

  1. DUI Refusal – refusing to submit to an alcohol test, or
  2. DUI Above the “Per Se” Threshold – this means having a blood alcohol level equal to, or greater than, the legal threshold: .08 if 21 or older, .02 if under 21, and .04 if driving a commercial vehicle,

then you have only 10 days (10 business days) after your arrest to request an administrative hearing to attempt to save your license from suspension.
